When Can I Get Divorced?
Since the Family Law Act in 1975 the only ground for divorce is separation for 12 months because of irreconcilable differences. Divorce in Australia is on “no fault” ground, in other words all that must be proved is separation for 12 months prior to the Divorce Application being made to the Court and that there is no possibility of reconciliation. It is possible to be legally separated but continue to live in the same house in certain circumstances. The Court also must ensure that proper arrangements have been made for any child of the marriage under the age of 18 years.
